OVERVIEW
Welcome to EDWARD HALE.
EDWARD HALE is an online retail brand operated by SICLOPAY LTD. Throughout these Terms of Service, the words “EDWARD HALE”, “we”, “us” and “our” refer to SICLOPAY LTD, trading as EDWARD HALE.
We operate the EDWARD HALE online store and website, including the information, content, features, products and customer services made available through it. Our store is hosted by Shopify, which provides the e-commerce platform that allows us to offer our products to you.
These Terms of Service, together with our Privacy Policy, Refund Policy, Shipping Policy and any other policies referenced on our website, govern your access to and use of our website and your purchase of products from EDWARD HALE.
Please read these Terms carefully before using our website or placing an order. By accessing the website, creating an account or purchasing a product, you agree to these Terms. If you do not agree, you should not use our website or services.
Nothing in these Terms limits any mandatory consumer rights available to you under applicable law.
SECTION 1 — ELIGIBILITY AND ACCOUNT INFORMATION
By using our website, you confirm that you are at least the age of legal majority in your country or place of residence. If you are under that age, you may use the website only with the involvement and consent of a parent or legal guardian.
You may be required to provide information such as your name, email address, billing details, payment information and delivery address. You agree that all information provided by you is accurate, current and complete.
If you create an account, you are responsible for keeping your login details secure and for activity carried out through your account. Please contact us promptly if you believe that your account has been accessed without authorisation.
SECTION 2 — PRODUCTS
We make reasonable efforts to present our products accurately, including their colours, materials, details, dimensions and appearance.
However, colours and textures may appear differently depending on your screen, device settings and lighting conditions. Natural materials and textured fabrics may also show slight variations in colour, grain or texture. These variations are not necessarily defects.
Product descriptions, prices and availability may be updated without prior notice. We may discontinue products or limit the quantities available to a customer, region or jurisdiction.
All products are subject to availability.
SECTION 3 — ORDERS
Submitting an order constitutes an offer to purchase products from EDWARD HALE.
We reserve the right to accept, decline or cancel an order where reasonably necessary. This may include suspected fraud, payment problems, pricing errors, stock discrepancies, delivery restrictions or orders that appear to have been placed for unauthorised resale.
Your order is accepted when we confirm acceptance or dispatch the products, depending on the communications sent during checkout and fulfilment.
Payment must be successfully authorised before an order can be fulfilled.
Please review your order, selected style, colour, size where applicable, and delivery information carefully before submitting it.
If you need to request a change or cancellation, contact us immediately. We cannot guarantee that a change can be made after the order has entered processing or fulfilment.
Products purchased from EDWARD HALE are intended for personal or household use and not for unauthorised commercial resale.
SECTION 4 — PRICES AND PAYMENT
Prices, discounts and promotions may change without prior notice. The price charged will be the price displayed and accepted at checkout when the order is submitted.
Any applicable taxes, shipping charges, customs duties or import fees will be displayed or handled in accordance with the information provided during checkout and in our Shipping Policy.
Where customs duties or import taxes are not included in the amount paid at checkout, they may be charged by the destination country. The customer is responsible for such charges unless otherwise stated or required by law.
You agree to provide accurate and complete billing and payment information. You confirm that you are authorised to use the payment method submitted with your order.
Payments are processed through secure third-party payment providers. EDWARD HALE does not directly store complete card details.
SECTION 5 — PROMOTIONS AND DISCOUNTS
Promotions, discount codes and quantity-based offers are subject to the conditions displayed on our website at the time of purchase.
Unless otherwise stated, discounts cannot be exchanged for cash, transferred to another customer or applied retrospectively to a completed order.
Where an additional quantity discount applies, the eligible discount will be calculated automatically at checkout after the required number of qualifying products has been added to the cart.
Our current quantity-based offer may include:
Buy 2 qualifying caps — 15% extra off
Buy 3 qualifying caps — 20% extra off
Buy 4 or more qualifying caps — 25% extra off
Where available, the applicable discount will be automatically applied at checkout.
We may correct, suspend or withdraw a promotion in cases of technical error, misuse, fraud or circumstances outside our reasonable control.
This does not affect orders that have already been validly accepted, except where permitted by law.
SECTION 6 — FINAL CLOSING SALE
Products offered during the EDWARD HALE Final Closing Sale are available in limited quantities.
No restocks or second releases are planned for products sold as part of our final collection.
Once a style, colour or size sells out, it may no longer be available.
Final Closing Sale purchases remain subject to the return rights described in our Refund Policy and to any mandatory rights provided by applicable consumer law.
Because remaining inventory is limited, we cannot guarantee that another style, colour, size or replacement product will be available for an exchange.
The closing of the EDWARD HALE store does not remove the support obligations applicable to orders already placed.
Orders made during our Final Closing Sale remain supported by our published shipping, returns, refund and customer care policies.
SECTION 7 — SHIPPING AND DELIVERY
We aim to process and dispatch orders within the timeframes displayed on our website or stated in our Shipping Policy.
EDWARD HALE currently offers free worldwide shipping where indicated on our website and at checkout.
Delivery dates and transit times are estimates.
Carrier delays, customs procedures, weather conditions, public holidays, incorrect delivery information and other events outside our reasonable control may affect delivery.
The customer is responsible for providing a complete and accurate delivery address.
Additional costs resulting from an incorrect or incomplete address, an unclaimed parcel or a refused delivery may be charged to the customer where permitted by law.
Nothing in this section limits consumer rights relating to delayed delivery or the seller’s responsibility for goods until delivery under applicable law.
SECTION 8 — RETURNS, EXCHANGES AND REFUNDS
Returns, exchanges and refunds are governed by our Refund & Return Policy, which forms part of these Terms.
Return or exchange requests must be made within the applicable return period.
Products must satisfy the return conditions stated in our Refund & Return Policy.
Because EDWARD HALE is currently offering its final collection, exchanges remain subject to remaining product, colour and size availability.
Nothing in these Terms or our Refund & Return Policy removes any mandatory right of withdrawal or legal remedy available to the customer.
SECTION 9 — ACCURACY OF INFORMATION
We aim to keep the information on our website accurate and current.
Occasionally, product descriptions, prices, promotions, availability, delivery information or other content may contain an error or omission.
We may correct errors and update information when necessary.
If an error materially affects an order you have placed, we will contact you and provide an appropriate option, which may include confirming the corrected order or receiving a refund.
SECTION 10 — INTELLECTUAL PROPERTY
The website and its content, including the EDWARD HALE name, branding, logos, product photography, text, graphics, videos, designs and page layouts, are owned by or licensed to SICLOPAY LTD and are protected by applicable intellectual-property laws.
You may access the website for personal and non-commercial use.
You may not reproduce, distribute, modify, republish, sell, license or commercially exploit our website or content without prior written permission.
The EDWARD HALE name, logos, designs and slogans may not be used in a manner that suggests endorsement, association or ownership without our written consent.

We do not control third-party websites or services and are not responsible for their content, availability, security or practices.

SECTION 12 — SHOPIFY
Our online store is hosted by Shopify.
Shopify provides the technical platform that enables us to operate the website and process online transactions.
Products purchased through the EDWARD HALE store are sold by SICLOPAY LTD, trading as EDWARD HALE, and not by Shopify.
Shopify is not the seller of our products and is not responsible for product quality, fulfilment, delivery, returns, refunds or customer support relating to an EDWARD HALE order.
SECTION 13 — PRIVACY
Personal information collected through the website is handled in accordance with our Privacy Policy.
Because our store is hosted by Shopify, certain information may also be processed by Shopify and by service providers involved in payments, fraud prevention, fulfilment, delivery, analytics and customer support.

SECTION 14 — REVIEWS AND CUSTOMER CONTENT

You grant EDWARD HALE a worldwide, non-exclusive, royalty-free licence to use, reproduce, adapt, publish and display that content for purposes connected with operating, improving and promoting our business.

Our total liability relating to an order will not exceed the amount paid for that order, except where a different limitation is required by applicable law.
Nothing in these Terms excludes or limits liability for:

- Fraud or fraudulent misrepresentation;
- A deliberate breach of legal obligations;
- Mandatory consumer rights;
- Any liability that cannot lawfully be excluded or limited.
SECTION 18 — INDEMNIFICATION
To the extent permitted by law, you agree to reimburse SICLOPAY LTD for reasonable losses, liabilities or expenses resulting directly from your unlawful use of the website, your infringement of another person’s rights or a serious breach of these Terms.
This section does not apply where the loss was caused by our own negligence, misconduct or breach of law.
SECTION 19 — SUSPENSION AND TERMINATION
We may suspend or terminate access to the website or an account if we reasonably believe that the website has been misused, these Terms have been materially breached or fraudulent or unlawful activity has occurred.
Termination does not affect rights or obligations that arose before termination, including outstanding payment obligations, accepted orders and provisions that are intended to continue after termination.

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be limited or removed only to the extent necessary.
The remaining provisions will continue in full force and effect.

These Terms, together with the policies referenced on our website, constitute the agreement between you and EDWARD HALE concerning your use of the website and purchases made through it.

The courts of Limassol, Cyprus, will have jurisdiction, subject to any mandatory consumer rights that apply in your country of residence.
If you are a consumer in the European Union, nothing in these Terms prevents you from relying on the mandatory laws or courts available to you in your country of residence.

We may update these Terms to reflect changes to our products, services, business practices or legal obligations.
The current version will always be available on this page.
Where required by law, we will provide notice of material changes.
Changes will apply from the effective date shown in the updated Terms and will not unfairly alter orders already accepted.
